New Gas Station, Variance Requests on May 2023 ZAB Meeting

The Henry County Zoning Advisory Board next meets on Thursday, May 25, 2023. The May 2023 ZAB meeting will consider a request for a new gas station and several variance requests.

Altogether, there are fourteen items on the May agenda. The new gas station would be at state routes 138 and 155 in Stockbridge.

May 2023 ZAB Meeting

The zoning advisory board meeting begins at 6:30 pm. They meet at the county admin building in McDonough. Each request below will have a public hearing, though staff can combine concurrent requests into the same presentation. That may prove especially useful since seven agenda items are from one applicant.

Salem Oaks Investors, LLC has applied for seven variances, all related to setback requirements for lots within their new subdivision. Salem Oaks is presently under construction on highway 155 in McDonough. Henry County approved a rezoning request for the property in fall 2020.

In addition, the board will consider two other variances. They are as follows:

  • Request for relief from highway corridor overlay district standards, 53 acres on highway 155 east of Prologis Park Road, and
  • Request to reduce the minimum parking space requirements, 1.3 acres at 2080 Jonesboro Road.

The requests above relate to the new McDonough 75 Logistics Center and an outparcel at the Crofthouse McDonough apartments, respectively.

The zoning board will also consider a conditional use permit. The application is for a non-commercial dog kennel at 639 Dailey Mill Road. The zoning board has decision-making powers on variance requests and use permits. The board of commissioners would only consider the items above on appeal.

Rezoning Requests

Continuing further, there are three rezoning requests for the May ZAB meeting. The zoning board makes a recommendation only on these items. The county commissioners must consider them at a later date to make a final decision.

The requests include the following:

  • Rezone 106 acres from RA to R-5 for a new subdivision, accessible from Wildwood Road in Clayton County. The location is at the very southwestern corner of Henry County, and part of a larger property partially in Clayton County.
  • Rezone 1.9 acres from RA to C-2 at the southeast corner of state routes 138 and 155 for a new gasoline service station, and
  • Request to rezone 5.6 acres from RA to C-1 at 498 and 526 Fairview Road for new office space.

The request at state routes 138 and 155 has concurrently applied to amend the land use map. The applicant is seeking to amend the map from rural residential to commercial. The map amendment will likewise go before the commissioners for a final decision.
