
The Henry County Zoning Advisory Board next meets on Thursday, September 12, 2024. Several cases have been postponed; a proposed service station remains on the agenda. The new gas station is looking to build on highway 155 at Millers Mill Road.
The zoning board meets at the county admin building in McDonough. Their meeting starts at 6:30 pm.
September Postponed Cases
Originally, the zoning board had four rezoning requests on their September agenda. Three cases have been postponed to a later date — two postponements by county staff and one by the applicant. Henry County Planning & Zoning postponed the following cases, both located in district 5:
- The Revive Land Group, LLC of Atlanta, GA requests a rezoning from RA to R-5 (Single-Family Residence) for property located on Mount Carmel Road, east of North Mount Carmel Road. The property consists of 29.094 +/- acres and the request is for a single-family subdivision.
- DR Horton of Conyers, GA requests a rezoning from RA to R-2 (Single-Family Residence) for property located south of Mount Carmel Road and west of Jones Road. The property consists of 110.885 +/- acres and the request is for a single-family subdivision on septic.
Next, Ryan Homes of Peachtree Corners, GA postponed their rezoning request in Fairview. They have applied to rezone 44 acres from RA to RM (Multifamily Residential). The property is located at south of Anvil Block Road, west of Bowden Road. They are proposing a townhome development.
The above cases will be rescheduled for a later date. Remaining on the agenda is a proposed gas station discussed in more detail below.
New Gas Station Millers Mill Road
Tushar Patel of McDonough, GA has applied to rezone 2.2 acres of land. They are located at the northwest corner of highway 155 and Millers Mill Road. Specifically, Mr. Patel is applying to rezone the property from RA to C-1 (neighborhood commercial). He is proposing a convenience store and gas station at the location.
To support the request, the applicant has also applied to amend the county’s future land use map. He is requesting to change the map from medium-density residential to commercial.
The applicant owns Royal Seven, a local convenience store and fast casual restaurant franchisee. As of September 2024, the company owns ten service stations with another seven in development. Their locations are in Clayton, Henry, Butts, Spalding and Monroe Counties along I-75. One such upcoming location by Royal Seven is at East Lake Parkway and Springdale Road.
According to the applicant’s rezoning application, they are proposing a 6,750 square feet retail store. There would be the primary convenience store as well as space for a restaurant. In addition, there are sixteen fueling stations depicted on their site plan.
Staff Review
Henry County planning staff have reviewed the request for its consistency to the comprehensive plan and compatibility to surrounding land uses. They review nine criteria altogether when making their recommendation on a rezoning request. Following their review, they are recommending denial. They similarly are recommending denial of the associated comp plan amendment.
The staff report states ”the request to develop a commercial development is not consistent with the current FLUM designation of Medium Density Suburban Residential, which would support residential development with a density of up to 4.0 dwelling units per acre, net.” It further states “the area in the immediate vicinity of the subject property, consists of RA (Residential-Agricultural) single-family residences.”
The zoning board will consider the staff recommendation, applicant’s presentation and hold a public hearing when they meet on Thursday. Afterwards, they will recommend to either approve or deny the request. The case must go before the board of commissioners at a later date. The county commissioners will then make the final decision whether to approve it.
